Scope:
1.1 Donnart Art Gallery Germany (hereinafter “we”) carries out your internet order based on the following General Terms and Conditions (“GTC”) in the form valid at the time of your order.

Conclusion of Contract:
2.1 All information about products, product characteristics, and prices is subject to errors. Our offer is non-binding.
2.2 After placing an order, we will first confirm the receipt of your order. You are obliged to inform us of any discrepancies between this confirmation and your order.
2.3 Acceptance of the contract by us only takes place upon the delivery of the goods.

Right of Withdrawal:
3.1 Commencement of the Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, take(s) possession of the last goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3.2 Consequences of Withdrawal:
If you withdraw from this contract, we will reimburse you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. You must return or hand over the goods to Donnart Art Gallery, Wichlinghauser Weg 43, 33829 Borgholzhausen, Germany, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods. The costs are estimated to be up to approximately 50 euros. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

3.3 Frames excluded from withdrawal after production
Please understand that already manufactured shadow box frames, if defect-free, are excluded from exchange. The frames are custom-made for the artwork and tailored to customer preferences.

Delivery / Shipping Costs:
4.1 We will gladly provide you with information on delivery times upon request.

4.2 Since our original works are traveling throughout Europe in companies or exhibitions, our delivery times vary greatly.

Therefore, we will discuss the delivery time with you in advance. Usually, we deliver within 1-6 weeks. The delivery time is a maximum of 3 months. We thank you for your understanding.

4.3 The shipping costs for the artworks are fully covered by Donnart Art Gallery. The costs for returning ordered artworks are at the buyer’s expense.

Payment Terms and Retention of Title:
5.1 Delivery is subject to advance payment.

5.2 Our prices include the currently applicable German value-added tax.

5.3 The delivered goods remain our property until full payment has been made.

5.4 If you are in default of payment, we are entitled to demand default interest.

Warranty and Liability:
6.1 Warranty is provided in accordance with statutory provisions, whereby we, in the event of a defect in the goods, will, at our discretion, either deliver a replacement or rectify the defect. If the rectification fails or the replacement goods are also defective, you may return the goods and receive a full refund.

Data Protection:
7.1 We use the data provided by you for processing your request or fulfilling our contract jointly. We do not pass on this data without your consent. The processing of your data is based solely on your consent. You can revoke this consent at any time. A formal statement by e-mail is sufficient for this purpose. The legality of data processing operations carried out before the revocation remains unaffected by the revocation.

7.2 The data you provide will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies. Mandatory legal provisions remain unaffected.

7.3 Facebook Pixel and Related Technologies
We use Facebook Pixel, a tool by Meta Platforms, Inc., USA, to enhance the analysis, optimization, and commercial utilization of our site. With Facebook Pixel and additional technologies like Automatic Advanced Matching (AAM) and Conversion API (CAPI), we can track user actions after they have viewed or clicked on an ad on Facebook and shown interest in our website and/or Facebook page.
Automatic Advanced Matching (AAM) allows us to send encrypted information such as emails or phone numbers to more accurately link users’ actions with their Facebook profiles. Conversion API (CAPI) enables the direct sharing of actions taken on our website (e.g., purchases and registrations), providing an additional way to measure ad performance without relying solely on cookies.
This helps us track the effectiveness of our Facebook ads and gather statistical data. The data collected in this way is anonymous to us, and we do not receive information about individual users. However, the data collected by Facebook through Pixel, AAM, and CAPI is stored and processed by Facebook, allowing it to be linked to the corresponding user profile, and Facebook may use this information for its own advertising purposes.

Jurisdiction
8.1 Jurisdiction is the Local Court of Bielefeld.

The German version of the terms and conditions is binding.
